"CREATING THE PIGCAWAYAN BAMBOO INDUSTRY DEVELOPMENT COUNCIL (PBIDC) TO PROMOTE THE BAMBOO INDUSTRY DEVELOPMENT PROJECT AND DIRECTING THE USE OF BAMBOO FOR THE DESK AND OTHER FURNITURE REQUIREMENTS OF PUBLIC ELEMENTARY AND SECONDARY SCHOOLS AND PRIORITIZING THE USE OF BAMBOO IN FURNITURE, FIXTURES AND OTHER CONSTRUCTION REQUIREMENTS OF GOVERNMENT FACILITIES AND ALLOCATING FUNDS THEREFORE AND HARMONIZING AND INTEGRATING ALL ORDINANCES PERTINENT THERETO AND FOR OTHER PURPOSES  "

WHEREAS, the Philippine Constitution protects and advances the rights of the people to a balanced and healthy ecology in accord with the rhythm and harmony of nature;

WHEREAS, The Local Government Code of 1991 has devolved the management of the municipal environment and natural resources, its rivers and contributories to the municipal government;

WHEREAS, the municipal government is committed to promote industrialization based on agricultural development and agrarian reform through industries that make full and efficient use of human and natural resources and which are competitive in both domestic and foreign markets;

WHEREAS, from the reference of the National Government that the Republic of the Philippines has committed to reforest at least 500,000 hectares with bamboo as part of the 1 million hectares of designated areas as its contribution to the ASEAN commitment of 20 million hectares of new forest by
2020 as part of its initiatives to improve the environment; from which the Municipal Government of Pigcawayan shall allocate 5,000 hectares, mostly and prioritizing the lands alongside the rivers and other contributories for bamboo plantation.

WHEREAS, the municipality of Pigcawayan is a flood prone area and it has been established that planting and use of bamboo will significantly contribute to the mitigation of climate change, reduce water flow and disaster management considering its carbon capture capability and cheaper reforestation cost. Furthermore, bamboo can be easily transformed into a cash crop for farmers and community-based forest management agreement holders who engaged in its cultivation thereby alleviating poverty;

WHEREAS, the growing advocacy for green products is fueling the rapid growth of the US$ 8 billion dollar per annum market for traditional and nontraditional bamboo products, is fast becoming a cost effective and attractive complement and/or alternative to plastic, metal-and wood materials and can generate jobs and self-employment opportunities in both rural and urban areas.


WHEREAS, there is a need to assist the Barangays, private organizations, small business owners engaged in bamboo production, mostly considering idle and marginalized areas, flood prone, landslide, erosion and collapsing riverbanks, upland areas which are covered with CBFM (Community Based Forest Management), sitios which are less in agricultural crops productions and thereby assist them to establish bamboo plantations and likewise resettlement of the settlers from risky waterways.

WHEREAS, there is a need to aggressively promote the product development and market access to sustain the development of bamboo industry.

WHEREAS, there is a need to create a council as Pigcawayan Bamboo Industry Development Council which shall be made as one of its investment priority program and the council shall provide the over-all policies and program directions for all stakeholders.

Section 1. Pigcawayan Bamboo Industry Development Council - The council shall be composed by the Office of the Municipal Mayor as Chairman, and members are Sangguniang Bayan Chairman of the Committee of Agriculture, SB Chairman of the Committee of Environment and Natural Resources, SB Chairman of the Committee on Livelihood and Community Welfare, Municipal Environment and Natural Resources Officer, the Department of Trade and Industry, Department of Agriculture, Municipal Planning and Development Office, Department of Education, Executive Committee Chairman, Municipal Councilor’s League Chairman, Association of Barangay Captain Chairman, Chairman of Pigcawayan Bamboo Industry Association, One(1) representative from Non-Government Organization, Two(2) representative from Private Industry Association.

Section 2. EXECUTIVE COMMITTEE – the EXECOM shall likewise be created with the membership composition of the Pigcawayan Bamboo Industry Development Council and shall mainly assist the council in terms of resource generation, project identification and program directions.

Section 3. FUNCTIONS OF THE EXECUTIVE COMMITTEE – The EXECOM shall direct the preparation of the Pigcawayan Bamboo Industry Development Council for the Medium Term Development of Bamboo Industry for the year 2011-2021. Likewise, the EXECOM shall identify, prioritize and recommend initial strategic interventions, research directions and Critical Data needs while the development plan is being drawn. Critical Data would be the inventory of all species of the existing bamboo supply, possible areas of expansion, identification of areas with immediate concern like disaster prone and high level of poverty incidence, water conservation, CBFM and forest reserved areas.

Section 4. SECRETARIAT- the secretariat shall be composed of the Department of Trade and Industry and a Technical Working Group. It shall facilitate the planned activities, update of the development, suggest improvement in all aspects, monitors the progress and quality of the programs being initiated and an active complement of the bamboo industry development initiatives.




Section 5. BAMBOO INDUSTRY TRAINING CENTER – a training center shall be established within the municipality that should be accessible to all stakeholders for the basic and advanced training on bamboo productions and other related trainings related to bamboo production and development. CITC and competent resource persons shall be enlisted to maintain the quality of the training and the learning itself. This training center will also conduct training in Bamboo Shoot Production, Propagation and Plantation Management, Quality Controlling and Monitoring, Machinery Operation and Safety Standards in Bamboo Production, and other related bamboo production processes. The Building/ training center shall be provided with amenities conducive to learning e.g. basic bamboo related tools and machineries, complete set of computer with printer, a multimedia projector and screen, phone and internet connection, table and chairs (made of engineered bamboo) comfort room, aerations and ventilations, conference and lecture room. To maximize resources and close collaboration on the bamboo development, the Training Center and the Marketing Center shall be established in one place.
           
            Section 6.  MARKETING CENTER – a marketing center shall be established for this is vital to the sustainability of the bamboo industry; shall collect data and volume of the bamboo supply and the existing species being propagated, it will serve also as warehouse, pasalubong and display center, showcasing the bamboo novelty products of Pigcawayan and Quality Controlling Center. It shall be manned with competent and well trained management and support staff for it will be the alter ego of the Municipality of Pigcawayan itself. Support staff shall consist of;

                                    1.  Marketing Manager
2.    Quality Controlling Specialist
3.    Multimedia Marketing Development Specialist
4.    Customer Care Specialist

            Section 7. BAMBUSETUM AND RESEARCH AND DEVELOPMENT CENTER – a 3 hectares bambusetum shall be established for the purpose of research, an eco tourism park and bamboo conservation area. A research and development facility shall be established within the municipality for the in-depth study of bamboo features, characteristic and other thorough analysis in improving the quality of the raw materials as well as the finished products of bamboo. Study the possibilities of bamboo as an alternate fuel and production of Bio oil, biocoal, feedstock production.  A cloning facility and a bamboo nursery shall be established adjacent to this facility to aid the researchers. Researcher(s) who are dedicated to the physiology and genetics development of the bamboo shall man the R & D center.

            Section 8. MARKETING LINKS – in promotion of the native products and engineered products produced from bamboo, the council shall aid in sales and promotion, facilitate transport and handling as well as forge market linkages, expansion and product development to sustain the bamboo industry. All Bamboo industry players who legally exist, with business permits and licenses, Registered Business Names, Cooperatives engaged in bamboo commercialization, Private Organizations duly registered to the Department of Labor and Employment as People’s Organization, registered to Securities and Exchange Commission as corporation or association shall be duly assisted by Department of Trade and Industry, DA and other concerned Agencies for the bilateral responsibility sharing.
Section 9. CORPORATE SOCIAL RESPONSIBILITY – The council shall enforce the law of fair trade practices by ensuring that all industry players e.g. bamboo producers (nurseries and commercial plantations), transport, producers of traditional bamboo products, producers of engineered bamboo products, wholesaler and retailers of bamboo products, bamboo artists and artisans, producers and fabricators of bamboo production machineries, marketing linkages shall be duly registered or secure business permits and licenses from concerned agencies therein.
Bamboos that are going to be harvested from water conservation, forest reserved and riverbanks shall secure a Permit to Cut authorization from the DENR and shall not exceed to the annual allowable cutting being provided and mandated by law. Exemption of the permit to cut documents are hereby waived to the CBFM and Private Commercial Bamboo Plantations but shall not compromise the quality of the materials being harvested and sold purposely for engineered bamboos. Likewise all manpower that are involved in harvesting should be competently trained and understand the Corporate Social Responsibility in providing raw materials to the clients.

            Section 10. CAPTIVE MARKET – the Department of Education within the municipality, the province and the region shall be the captive market and procurement of furniture made of engineered bamboo as raw material like bamboo tables, cabinets, chalkboards, desks and armchairs. The Department of Public Works and highways, Municipal Engineering Office and other government agencies that are planning, repairing and improving buildings shall use engineered bamboo in replacement of wood materials.

            Section 11. CULTURE AND ARTS PRESERVATION – to encourage cultural preservation, the native and traditional dances using the bamboo e.g. singkil, subli and tinikling shall be promoted, taught and be a part of the instruction module on every school, primary, intermediate and secondary education. On Technology and Livelihood Education, engineered bamboo should be the material for woodworks, crafts and technology development like mat board weaving, paper production, flavone production, yarn and filament, wine and beverages production, food development technology on Bamboo Shoots as food and animal and fisheries feeds component. A bamboo planting activity shall be initiated to every school that has ecology and environmental organization as their socio civic organizing event. TESDA shall make a full collaboration in accrediting the Trainings, Seminars and Workshops with bamboo and be accredited as National Competency – Level 2.

Section 12. Budgetary Requirements – for the council to be functional, operational and for the administrative expenses, an amount of 5,000,000.00 shall be allocated from the Annual Budget for the Poverty Alleviation, Livelihood and Income Generation, Climate Change Mitigation, Disaster Risk Management, Investment Priority Program and other aligned budgetary as being provided by law. The council may raise funds from other sources for specific project as being authorized by law.

Section 13. BAMBOO CELEBRATIONS – in consonance of the significance of the bamboo grass, the stakeholders shall make it a special event and the Municipality of Pigcawayan together with line agencies and industries related to bamboo development shall be enjoined to spearhead the event organizing and coordination with concerned government agencies, private organizations and among stakeholders.

            5.1 – World Bamboo Day – A world wide celebration on bamboo plant and its significant feature in helping the ecosystem and it shall be celebrated during and every September 18 and every succeeding year thereof.

            Section 14. Separability:  If any section, phrase, sentence or portion of this ordinance is held invalid or unconstitutional for any reason by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision; and such holding shall not affect the validity of remaining portions thereof.

          Section 15. Ordinance Repealed: All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.

            Section 16. Effectivity Date. This Ordinance shall take effect on _______________, 20__, after its passage, approval, and publication according to law.
